Terms of Use
1. Acceptance of Terms
These Terms of Use (“Terms”) are a binding agreement between you and FIRE INTERACTIVE LLC (“we”, “us”, “our”), the operator of Paint & Seek 2D (the “Game”). By accessing or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
Effective date: June 22, 2026. We may update these Terms; continued use after changes means you accept the updated Terms.
2. Eligibility & Age
You must be at least 13 years old to play. If you are under the age of majority where you live, you may use the Game only with the consent and supervision of a parent or legal guardian. The Game is not directed to children under 13, and we do not knowingly collect personal information from them.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and play the Game for your own non-commercial entertainment. All rights not expressly granted are reserved. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Game except as permitted by law.
4. Conduct & User Content
You are solely responsible for the display names, room names, chat, avatar artwork, and any other content you create or transmit (“User Content”). You agree not to create or share content that is unlawful, harassing, hateful, threatening, defamatory, obscene, sexually explicit, infringing, or that impersonates others. You agree not to cheat, exploit bugs, disrupt other players, or interfere with the Game's operation.
You retain ownership of your User Content but grant FIRE INTERACTIVE LLC a worldwide, royalty-free license to host, display, and transmit it as needed to operate the Game. We do not monitor all User Content, are not responsible for it, and may remove content or suspend or terminate access at our discretion and without notice.
5. Disclaimer of Warranties
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT IT WILL ALWAYS BE AVAILABLE.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRE INTERACTIVE LLC AND ITS OWNERS, MEMBERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE GAME WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
7. Indemnification
You agree to indemnify and hold harmless FIRE INTERACTIVE LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Game, or your violation of these Terms or any law or third-party right.
8. Third-Party Services
The Game relies on third-party services to function, including Playroom Kit (real-time multiplayer networking) and Cloudflare (hosting and the public room directory). Your use of the Game may be subject to those providers' terms and privacy policies. We are not responsible for third-party services.
9. Termination
We may suspend or terminate your access to the Game at any time, with or without cause or notice. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
10. Governing Law
These Terms are governed by the laws of the United States and the State of Illinois, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located there for any dispute not subject to arbitration or small-claims court.
